Terms of Service

These Terms explain how Savor Everything accounts, orders, payments, delivery coordination, Savor Pass, Savor Atlas, Savor credits, and Savor GPT actions work.

Important summary

Savor Everything does not store full payment card numbers, CVV/CVC codes, PIN data, or other sensitive cardholder authentication data. Card payment is completed through hosted checkout or payment provider tools. Savor GPT cannot complete card payment inside ChatGPT. The separate in-app auto-checkout beta is off by default and can use a saved payment method only after explicit account-level opt-in.

1. Agreement to These Terms

These Terms of Service are a legal agreement between you and Savor Everything governing your access to and use of Savor Everything websites, applications, account features, restaurant discovery, ordering, delivery coordination, Savor Atlas, Savor Pass, Savor ID, Savor credits, support channels, and Savor GPT features.

By browsing, creating an account, signing in, placing or preparing an order, purchasing or redeeming credits, joining Savor Pass, submitting a review, connecting Savor GPT, or otherwise using Savor Everything, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.

Some services may have additional posted terms, restaurant policies, promotion rules, or payment provider terms. Those additional terms apply to the applicable feature and will control if they conflict with these Terms for that feature.

2. Electronic Contracting and Records

You agree to transact with Savor Everything electronically. Under the Electronic Transactions Act, Cap. 308B of Barbados, electronic records, electronic signatures, and electronic acceptance have legal effect. When you tap, click, or otherwise indicate acceptance of these Terms, place an order, or authorize a payment, you are entering into a binding electronic agreement.

You agree that we may keep records of these Terms, orders, receipts, notices, and communications in electronic form, and that those electronic records satisfy any requirement that such information be in writing. You are responsible for keeping your own copies of receipts and confirmations we make available to you.

3. Who We Are and What We Do

Savor Everything operates a Barbados-focused food ordering and delivery marketplace. The Services are provided by Savor Everything (operated by [Savor Everything legal entity — to be confirmed], a business established in Barbados). We help users discover restaurants, build carts, place orders, coordinate payment handoff, route orders to restaurants or fulfillment workflows, coordinate delivery where available, provide account features, and support loyalty, credits, reviews, and AI-assisted ordering tools.

Unless Savor Everything expressly states otherwise for a particular item or order, restaurants and other merchants are independent businesses responsible for preparing, packaging, pricing, describing, labeling, and supplying the food, beverages, and other items they make available through Savor Everything. Riders and delivery partners may be independent service providers. Savor Everything is not the manufacturer of restaurant food and does not control every restaurant kitchen, ingredient, allergen, substitution, or preparation decision.

Nothing in these Terms limits any non-waivable rights you have under Barbadian consumer protection, food safety, payment, data protection, or other laws, including the Consumer Protection Act, Cap. 326D and the Consumer Guarantees Act, Cap. 326E.

4. Eligibility and Accounts

You must be legally able to enter into a binding agreement to use the Services. If you are under the age of majority where you live, you may use the Services only with permission and supervision from a parent or legal guardian. You may not use the Services if we have suspended or terminated your account for abuse, fraud, safety, or legal reasons.

You agree to provide accurate, current, and complete account information, including your name, email address, phone number, delivery address, and payment or checkout information where required. You are responsible for keeping your account credentials secure and for all activity under your account unless that activity results from a security breach caused by Savor Everything.

We may require phone, email, OAuth, payment, fraud, or other verification before permitting account access, order placement, credit redemption, review posting, Savor Pass activation, Savor GPT connection, or other sensitive actions.

5. Account Security and Authorized Use

You must not share your password, authentication codes, OAuth tokens, API keys, payment credentials, or other account access credentials. If you believe your account has been compromised, contact us promptly and change your credentials.

You are responsible for ensuring that any person using your account is authorized to do so and follows these Terms. We may reject, pause, or cancel activity that appears unauthorized, abusive, fraudulent, automated, unsafe, or inconsistent with these Terms.

6. Restaurant Information, Menus, and Availability

Restaurant listings, menus, images, descriptions, modifiers, prices, hours, delivery availability, preparation times, item availability, and promotion details may change at any time. We work to keep information useful, but the final restaurant-prepared item may differ from photos, descriptions, or historical menu information.

A cart is not a confirmed order. An order is confirmed only when Savor Everything or the relevant restaurant workflow accepts it and any required payment or checkout step is completed. We may reject or cancel orders because of item unavailability, pricing or menu errors, payment failure, address issues, suspected fraud, safety concerns, restaurant closure, capacity limits, or other operational reasons.

If an item becomes unavailable after you place an order, we or the restaurant may contact you about a substitution, partial fulfillment, cancellation, refund, or credit. If we cannot reach you in time, we may make a reasonable operational decision, including removing the unavailable item or cancelling the order.

7. Food Allergies, Dietary Needs, Age-Restricted Items, and Safety

You are responsible for reviewing menu information, disclosing allergies or dietary restrictions in the available order notes, and confirming critical safety requirements directly with the restaurant where necessary. Savor Everything may provide dietary labels, search filters, AI-generated suggestions, menu summaries, or customer notes, but those tools are informational and may be incomplete or wrong.

Restaurants are responsible for ingredient sourcing, preparation, cross-contact controls, packaging, food safety, and allergen handling in their own kitchens. If you have a severe allergy, medical condition, religious dietary requirement, pregnancy-related restriction, or other safety-critical need, do not rely solely on app labels, Savor GPT, reviews, or automated suggestions.

Some items are age-restricted. Where alcohol is offered through the Services, it may be sold and supplied only to persons aged 18 or over, in accordance with the Liquor Licences Act of Barbados. By ordering age-restricted items you confirm you meet the minimum age. We, the restaurant, or the rider may require valid proof of age at handoff and may refuse or cancel delivery of alcohol or other restricted items if age or identity cannot be verified or if the recipient appears intoxicated. You must not order or receive restricted, unsafe, illegal, or improperly described items through the Services.

8. Orders, Pricing, Fees, and Taxes

You agree to pay all item prices, delivery fees, service fees, small-order fees, tips, taxes, payment processing charges, surcharges, subscription charges, credit purchases, and other amounts shown at checkout or otherwise accepted by you. Unless the checkout page states otherwise, customer-facing prices are displayed in Barbados dollars (BBD). Certain payment providers, credit purchases, or back-office billing flows may use another displayed currency.

Prices may be shown inclusive or exclusive of value added tax (VAT) and other applicable Barbadian taxes and levies, as indicated at checkout. Taxes, fees, discounts, Savor Pass boosts, credits, points, tips, and promotion rules may be calculated based on restaurant, delivery location, availability, user eligibility, or operational conditions. Estimates shown before checkout may change when final delivery location, restaurant acceptance, payment method, credits, or promotions are applied.

Tips are intended for the rider, delivery partner, or other fulfillment personnel according to Savor Everything's current tip handling practices. We may adjust a tip only where requested by you, required by law, required to correct an error, or needed to resolve fraud, failed payment, cancellation, or refund issues.

9. Payments and Hosted Checkout

Card payments are completed through Fygaro hosted checkout. Fygaro processes payment information under its own terms and privacy policies. You authorize Savor Everything and Fygaro to process the amounts you approve.

Savor Everything does not store full cardholder data. We do not store full primary account numbers, CVV or CVC codes, PIN data, magnetic-stripe data, chip data, or other sensitive authentication data. Card entry occurs on Fygaro-hosted checkout. Savor Everything may store operational records such as payment status, transaction and provider references, refund status, amount, currency, timestamps, and masked card brand or last-four details returned by Fygaro.

Do not send card numbers, CVV or CVC codes, bank credentials, payment passwords, government IDs, API keys, or other sensitive secrets through Savor GPT, support messages, reviews, delivery notes, restaurant notes, email, SMS, or any free-text field. We may delete, redact, or refuse to process such information.

If a payment fails, is reversed, is disputed, is suspected of fraud, or is not verified by the payment provider, we may pause or cancel the order, withhold fulfillment, suspend credits or benefits, seek repayment, or take other reasonable steps to protect users, restaurants, riders, and Savor Everything.

10. Refunds, Cancellations, Chargebacks, and Credits

Refund and cancellation eligibility depends on order status, restaurant acceptance, food preparation, rider dispatch, payment status, the nature of the issue, applicable law, and any restaurant-specific policy. Food orders often cannot be cancelled or refunded after the restaurant accepts or begins preparing the order unless required by law or approved by Savor Everything. This does not affect your rights where an order is not delivered, is materially incorrect, or is unsafe or not of acceptable quality under the Consumer Guarantees Act, Cap. 326E.

If we approve a refund, we may issue it to the original payment method, as Savor credits, as a partial refund, as a promotion, or through another lawful method. Payment providers and banks may take additional time to post refunds. Delivery fees, service fees, tips, payment processing charges, and used credits may be non-refundable except where required by law or where Savor Everything decides otherwise.

Please report a food-order issue as soon as reasonably possible and, where practical, within 48 hours after delivery so that receipts, photos, packaging, restaurant records, and delivery records can be preserved. This 48-hour request is an operational reporting target, not a waiver or shortening of any non-waivable right or the reasonable-time standard that may apply under the Consumer Guarantees Act, Cap. 326E.

You agree to contact Savor Everything support first so we can investigate missing, incorrect, delayed, unsafe, or unsatisfactory orders. If you file a chargeback or payment dispute without first giving us a reasonable opportunity to resolve the issue, we may provide transaction records to the payment provider, restrict account access, reverse credits or benefits, and decline future orders where allowed by law. The Creator Program's separate 14-day referral-validation period does not limit any customer refund, chargeback, or statutory consumer right.

11. Delivery, Pickup, and Rider Coordination

Delivery and pickup times are estimates, not guarantees. Actual timing can be affected by restaurant workload, item preparation, rider availability, traffic, weather, road closures, building access, delivery distance, incorrect address details, phone availability, public events, safety issues, platform outages, and other circumstances.

You are responsible for providing a complete and accurate delivery address, delivery instructions, phone number, and safe handoff location. If the rider cannot reach you, cannot safely access the location, or cannot legally complete the handoff, we may leave the order where reasonable, return it, cancel it, charge additional fees, withhold a refund, or take other reasonable action.

You must treat restaurant staff, support staff, riders, and delivery partners respectfully and lawfully. Harassment, threats, discrimination, unsafe conduct, false reports, abuse of rider location information, or attempts to lure riders or restaurants into off-platform transactions may result in order cancellation, suspension, or account termination.

12. Savor Credits, Gift Cards, Points, and Promotions

Savor credits, gift cards, promotional balances, points, coupons, referral awards, delivery boosts, and other benefits are not bank deposits, stored-value bank accounts, cash, or legal tender. They have no cash value unless required by law and may be used only through Savor Everything for eligible purchases or benefits.

Credits and promotions may be subject to eligibility rules, minimum order values, expiration dates, redemption limits, restaurant exclusions, delivery-area limits, one-per-customer limits, anti-fraud checks, or other posted conditions. We may correct accounting errors, reverse benefits issued by mistake, and suspend or cancel credits obtained through fraud, abuse, duplicate accounts, payment disputes, or policy violations.

You may not sell, broker, barter, scrape, duplicate, generate, guess, exploit, or transfer credits, gift card codes, coupons, points, or promotions except through features that Savor Everything expressly provides.

13. Creator Program, Referral Earnings, and Creator Cup

Approved creators may receive a personal referral code and access to Creator Studio. Applying to or remaining in the Creator Program may require connecting at least one social account through that provider's official sign-in so we can verify account ownership and audience size, and a creator's public profile information, such as handle, avatar, and follower counts, may be displayed in creator discovery, Savor Atlas, and Creator Cup features. A code entered at checkout records a pending attribution only. A referred order becomes an eligible order only after the code was valid when used, payment was completed, delivery was successfully recorded, and the order remained neither cancelled, refunded, reversed, nor excluded for 14 complete calendar days after its recorded delivery time. Dashboard totals, rankings, points, earnings, and prizes remain subject to correction and final review.

Unless posted rules say otherwise, only one eligible order per customer, per creator, per Barbados calendar day counts. Self-orders and orders connected to the creator's own account do not count. Duplicate or linked accounts, test or sham orders, collusive ordering, automated ordering, fabricated customers, recycled payment or delivery identities, manipulated deliveries, refund or chargeback schemes, and other activity intended to manufacture attribution, points, rank, earnings, or prizes are invalid.

When activity reasonably indicates mistake, abuse, fraud, or a violation of these Terms, Savor Everything may temporarily suspend the code, hold further attribution and payouts, preserve relevant records, and conduct a human review. If a human review confirms invalid activity or a material breach, Savor Everything may exclude or remove affected orders, recalculate earnings and rankings, reverse points, withhold or unqueue unpaid earnings and prizes, offset recoverable overpayments against future amounts where lawful, suspend or terminate Creator Program access, and ban associated accounts or codes. A creator may contact support@savoreverything.com to request review of an enforcement decision.

Eligible earnings are calculated at the posted tier rate. Time-limited promotional rate boosts, such as a new-creator signup boost, apply only for the posted window measured from code activation and end automatically when that window closes. The base earning rate requires at least 20 Savor Everything followers; higher posted rates require both the applicable points threshold and at least 50, 100, or 150 Savor Everything followers. The current operational schedule is monthly, with payout runs planned for the 5th day of a month after the applicable 14-day validation period and required review have completed, subject to the posted minimum payout threshold and payment-provider processing. An order delivered near month-end therefore will not be paid on the immediately following 5th. Later refunds, reversals, chargebacks, or confirmed fraud may still result in a lawful adjustment or recovery after the 14-day period.

Creator Cup periods use Barbados local time and are ranked using eligible orders under the posted Cup rules. Names may remain masked until final review. Qualification, prize amounts, funding, tie rules, eligibility, and payment remain subject to the official rules shown for that Cup period. Automated fraud signals can hold a result for human review but do not by themselves create a permanent ban. Savor Everything may correct rankings before or after reveal if invalid activity is confirmed.

Creators participate as independent contractors and not as employees, agents, partners, franchisees, or representatives of Savor Everything. Creators have no authority to bind Savor Everything, promise refunds, or speak on its behalf. Creators are responsible for their own taxes, registrations, and disclosures, and Savor Everything may request identity, payment, tax, or verification information and make reports required by law. Participation does not guarantee orders, earnings, prizes, hours, exclusivity, or continued access.

The version of these Creator Program terms accepted with an application, together with the server acceptance timestamp, may be retained as an electronic record. Material changes to creator eligibility, rates, validation periods, or payout rules will be posted or otherwise notified where required before they apply prospectively.

14. Savor Pass and Membership Features

Savor Pass and Savor Pass Foodie are membership programs that may include benefits such as delivery boosts, boosted dispatch priority, points-back opportunities, Savor GPT usage allowances, support prioritization, member deals, and other benefits shown at the time of enrollment. Benefits are subject to eligibility, monthly reset rules, restaurant participation, delivery availability, fraud checks, and operational limits.

If paid subscription billing is enabled, your Savor Pass membership renews monthly at the price shown when you enroll unless you cancel before the next renewal. You authorize Savor Everything and its payment providers to charge recurring membership fees, taxes, and any applicable payment charges. If a payment fails, we may suspend or end membership benefits.

You can cancel Savor Pass through your account where available or by contacting support. Cancellation stops future renewals but does not automatically refund the current billing period unless required by law or approved by Savor Everything. Benefits may remain available until the end of the paid period, may end immediately if the plan was free, promotional, fraudulent, or unpaid, and do not guarantee any specific restaurant deal, rider assignment, delivery time, or amount of savings.

We may change Savor Pass features, pricing, monthly allowances, usage limits, or eligibility rules. For material changes to paid recurring membership terms, we will provide notice where required and give you a reasonable opportunity to cancel before the change applies.

15. Savor GPT, ChatGPT, and AI-Assisted Ordering

Savor GPT is an AI-assisted experience that may operate through ChatGPT, OpenAI GPTs, OpenAI apps or actions, OAuth, and approved Savor Everything action endpoints. Savor GPT may help with restaurant discovery, cart building, checkout handoff, preferences, Savor ID, Savor Pass, order lookups, Savor Atlas reviews, and related account tasks where available.

ChatGPT and OpenAI services are third-party services governed by OpenAI's own terms, policies, privacy notices, plan availability, workspace settings, and platform controls. Unless OpenAI is expressly identified as the builder or operator of a particular Savor experience, OpenAI does not sponsor, control, or endorse Savor Everything or Savor GPT. Savor Everything controls only the Savor action endpoints and Savor data handling described in our Privacy Policy.

When you connect Savor GPT through OAuth or another supported sign-in flow, you authorize ChatGPT or another approved client to request approved Savor action calls for your account within the scopes you grant. Savor actions may read account information, restaurants, carts, orders, reviews, preferences, Savor Pass status, or other approved data, and may create or update draft carts, preferences, reviews, or checkout handoffs when you ask for those actions.

Savor GPT cannot complete card payment inside ChatGPT. A ChatGPT conversation may prepare a cart or checkout handoff, but payment must be completed through Savor Everything checkout or a hosted payment provider. Draft cart edits, recommendations, summaries, and checkout links are not final orders unless Savor Everything confirms an order through the normal order flow.

Separately, Savor Everything may offer an in-app Savor GPT auto-checkout beta. Auto-checkout is optional, is off by default, and requires an explicit account-level opt-in. If you opt in, you authorize Savor Everything and its normal payment processor to use the saved payment method you select to complete an order when Savor GPT acts on checkout instructions reasonably understood from you while the feature is enabled. Payment credentials remain handled as described in Section 9. We may require confirmation, verification, or other safeguards, and may reject, pause, or cancel a transaction for availability, payment, fraud, safety, or legal reasons.

You can disable auto-checkout in your account settings. Disabling it stops new Savor GPT auto-checkout instructions from being processed but does not cancel an order or payment already submitted. We may keep an electronic record of your opt-in, the Terms version you acknowledged, relevant instructions, order confirmations, and your later opt-out for security, support, payment, fraud-prevention, and dispute purposes.

AI output and actions may be inaccurate, incomplete, delayed, offensive, or unsuitable for your situation. Even when auto-checkout is enabled, you remain responsible for keeping your saved delivery address, payment selection, preferences, and instructions accurate and for reviewing available order confirmations. You are responsible for the restaurant, items and modifiers, allergy and dietary information, delivery address, totals, taxes, fees, tips, credits, promotions, substitutions, and restaurant or delivery instructions communicated through your account. Do not rely solely on Savor GPT for allergy or other safety-critical decisions. Savor GPT does not provide medical, legal, nutrition, financial, tax, or professional advice.

If an auto-checkout order is wrong, unauthorized, not delivered, unsafe, or otherwise disputed, contact Savor Everything support promptly. Refund, cancellation, chargeback, and support handling follows Section 10, the payment provider's applicable procedures, and your rights under law. Enabling auto-checkout does not waive any non-waivable consumer right, statutory remedy, or protection for unauthorized transactions.

To the maximum extent permitted by law and subject to Sections 24 through 26, Savor Everything is not responsible for losses caused by inaccurate or outdated information or instructions supplied through your account, or by an AI error that you knew or reasonably should have identified from information made available to you. This provision does not exclude or limit liability that cannot lawfully be excluded or limited, and it is not a waiver of liability for Savor Everything's negligence where applicable law does not permit that liability to be waived.

Do not put passwords, payment card details, bank credentials, government IDs, private health details, confidential business information, or unnecessary sensitive personal information into ChatGPT, Savor GPT, restaurant notes, support chats, or free-text fields. We may throttle, refuse, revoke, or log Savor GPT activity to protect security, prevent fraud, debug action failures, enforce these Terms, and comply with law.

16. Savor Atlas Reviews and User Content

You may be able to submit reviews, ratings, photos, preferences, allergy notes, delivery notes, restaurant notes, support messages, feedback, profile details, or other content. You retain your ownership rights in your content, but you grant Savor Everything a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, use, copy, display, reproduce, modify, excerpt, adapt, publish, translate, distribute, analyze, and create derivative works from that content for operating, improving, promoting, protecting, and providing the Services.

Reviews must reflect your honest, firsthand experience. You must not submit fake reviews, AI-generated fake reviews presented as real experiences, paid or incentivized reviews that fail to disclose the incentive, reviews posted on behalf of someone else, defamatory content, illegal content, discriminatory content, private personal information, spam, threats, or attempts to manipulate ratings.

We may moderate, reject, edit for formatting, hide, remove, rank, label, investigate, or preserve content to enforce these Terms, comply with law, protect users and partners, improve quality, or operate Savor Atlas. We do not promise to publish every review, and we may show reviews in different orders or contexts.

17. Prohibited Conduct

You must not misuse the Services or help anyone else misuse them. We may investigate and take action against conduct that harms Savor Everything, users, restaurants, riders, payment providers, OpenAI or ChatGPT integrations, infrastructure, security, or public trust.

  • Place fraudulent, abusive, test, prank, unauthorized, or payment-disputed orders.
  • Scrape, crawl, harvest, copy, reverse engineer, overload, bypass rate limits, or interfere with the Services.
  • Create duplicate, false, or misleading accounts to evade restrictions, obtain promotions, manipulate reviews, or abuse credits.
  • Attempt off-platform payment, refund, delivery, or restaurant arrangements designed to avoid fees, safety checks, or platform rules.
  • Upload malware, exploit vulnerabilities, probe systems without authorization, or access data you are not allowed to access.
  • Use Savor GPT, action endpoints, OAuth, or APIs for automated abuse, data extraction, spam, model training against our restrictions, or unauthorized commercial use.
  • Misrepresent your identity, affiliation, order status, payment status, restaurant relationship, rider relationship, or review experience.
  • Post or transmit content that is illegal, infringing, defamatory, obscene, hateful, discriminatory, threatening, harassing, deceptive, or invasive of privacy.

18. Intellectual Property

Savor Everything, Savor Pass, Savor ID, Savor Atlas, Savor GPT branding used by Savor Everything, logos, product names, service names, interface designs, software, databases, text, graphics, icons, photos, videos, data compilations, and other platform materials are owned by Savor Everything or its licensors and are protected by intellectual property and other laws. Savor Everything names and logos are trademarks of Savor Everything; you may not use them without our prior written permission.

Subject to your compliance with these Terms, Savor Everything grants you a limited, revocable, non-exclusive, non-transferable license to access and use the Services for personal, lawful ordering and account use. You may not copy, sell, rent, license, redistribute, frame, mirror, resell, modify, reverse engineer, or create competing products from the Services except as permitted by law or expressly authorized in writing.

If you provide feedback, suggestions, feature requests, or ideas, you allow Savor Everything to use them without restriction or compensation.

19. Communications and Notices

You agree that Savor Everything, restaurants, riders, payment providers, and support tools may contact you by email, phone, SMS, in-app notification, push notification, WhatsApp or similar messaging, or other reasonable channels for account security, verification, order updates, delivery coordination, payment issues, support, policy notices, and service announcements.

You are responsible for keeping contact details current. You can opt out of non-essential marketing messages where legally required or where opt-out tools are provided, but operational, security, legal, order, payment, and account messages may still be sent.

20. Third-Party Services and Links

The Services may integrate or link to third-party services, including payment processors, maps, analytics tools, hosting providers, OpenAI and ChatGPT, OAuth providers, restaurants, delivery tools, communication providers, and external websites. Third-party services are governed by their own terms and privacy practices.

Savor Everything is not responsible for third-party outages, data practices, fees, errors, policies, content, AI output, payment decisions, bank delays, map inaccuracies, restaurant websites, or external services, except to the extent required by law or expressly stated in these Terms.

21. Service Availability and Changes

We may change, suspend, restrict, discontinue, or remove any feature, restaurant, delivery area, membership benefit, promotion, credit feature, review feature, Savor GPT feature, action endpoint, or support channel at any time. We may perform maintenance, security upgrades, migrations, fraud investigations, and emergency changes without advance notice.

We do not guarantee that the Services will be uninterrupted, error-free, secure, compatible with every device, available in every location, or available through every ChatGPT plan, workspace, browser, network, app store, or payment provider.

22. Force Majeure

Savor Everything is not liable for any delay or failure to perform caused by events beyond our reasonable control, including natural disasters, hurricanes, storms, flooding, fire, power or internet outages, telecommunications or payment-provider failures, restaurant or supplier disruption, labor disputes, public health emergencies, government action, civil unrest, or acts of God. Where such an event occurs, affected obligations are suspended for the duration of the event, and this section does not affect your non-waivable statutory rights.

23. Suspension and Termination

You may stop using the Services at any time. We may suspend, restrict, terminate, or delete access to accounts, orders, credits, promotions, Savor Pass benefits, Savor GPT connections, reviews, or content if we reasonably believe you violated these Terms, created risk or liability, engaged in fraud or abuse, failed payment verification, threatened safety, infringed rights, or if we must comply with law or a platform provider requirement.

If your account is terminated, you remain responsible for amounts owed, chargebacks, unresolved disputes, and obligations that by their nature should survive termination. We may preserve records where needed for legal, tax, accounting, fraud prevention, security, support, or dispute purposes.

24. Your Consumer Rights

If you are a consumer in Barbados, you have rights under the Consumer Protection Act, Cap. 326D and the Consumer Guarantees Act, Cap. 326E that cannot be excluded, restricted, or modified by these Terms. Among other things, goods and services supplied to you should be of acceptable quality and fit for their ordinary purpose, and you may have a right to redress if they are not.

Nothing in these Terms is intended to exclude or limit any such non-waivable consumer guarantee or statutory remedy. Where a term of these Terms conflicts with a right you have under Barbadian consumer law, that consumer right prevails.

25. Disclaimers

The Services are provided on an as-is and as-available basis. To the maximum extent permitted by law, and subject to Section 23, Savor Everything disclaims all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, security, and quiet enjoyment.

We do not warrant that restaurant information, menus, prices, availability, delivery estimates, Savor GPT responses, recommendations, reviews, maps, credits, points, promotions, order status, or third-party service information will be accurate, complete, current, secure, uninterrupted, or error-free.

These disclaimers do not exclude or limit liability that cannot lawfully be excluded, including any non-waivable consumer guarantees under the Consumer Guarantees Act, Cap. 326E, statutory remedies, or liability for fraud, willful misconduct, or personal injury caused by negligence where such limitation is prohibited by law.

26. Limitation of Liability

To the maximum extent permitted by law, Savor Everything and its owners, directors, officers, employees, contractors, agents, affiliates, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or lost-profit damages, or for loss of goodwill, data, credits, reputation, business opportunity, or anticipated savings, even if advised that such damages may occur.

To the maximum extent permitted by law, Savor Everything's total liability for any claim relating to an order will not exceed the amount you paid to Savor Everything for the affected order, and Savor Everything's total liability for all other claims will not exceed the greater of BBD 100 or the amounts you paid to Savor Everything for the affected paid feature during the three months before the event giving rise to the claim.

The limitations in this section apply to all legal theories, including contract, tort, negligence, strict liability, warranty, statute, equity, and otherwise, but only to the extent permitted by applicable law, and do not limit liability that cannot lawfully be limited, including non-waivable consumer rights and liability for death or personal injury caused by negligence.

27. Indemnity

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Savor Everything and its owners, directors, officers, employees, contractors, agents, affiliates, licensors, service providers, restaurants, and delivery partners from claims, losses, liabilities, damages, fines, penalties, costs, and expenses, including reasonable legal fees, arising from your misuse of the Services, violation of these Terms, violation of law, infringement or misuse of third-party rights, fraudulent or abusive conduct, user content, reviews, off-platform arrangements, payment disputes caused by your conduct, or unauthorized use of your account.

If you are a consumer, this indemnity applies only to the extent allowed by applicable consumer protection law. Savor Everything reserves the right to control the defense of any matter subject to indemnification, and you agree to cooperate with that defense.

28. Governing Law, Disputes, and Complaints

These Terms are governed by the laws of Barbados, without regard to conflict-of-law rules, except where mandatory law in your place of residence requires otherwise. Before either party starts formal proceedings, both parties agree to try in good faith to resolve the dispute informally by contacting support@savoreverything.com with a description of the issue and requested resolution.

Subject to any mandatory consumer forum rights that cannot be waived, the courts of Barbados will have jurisdiction over disputes arising out of or relating to these Terms or the Services. Claims must be brought on an individual basis to the extent permitted by law, and not as a plaintiff or class member in a class, collective, consolidated, private attorney general, or representative proceeding.

Nothing in these Terms limits your right to complain to a competent authority. Consumers may contact the Fair Trading Commission of Barbados about consumer matters, and you may contact the Data Protection Commissioner of Barbados about how your personal data is handled. Nothing in this section prevents either party from seeking urgent injunctive or equitable relief for unauthorized system access, intellectual property misuse, account abuse, fraud, confidentiality breaches, or threats to safety.

29. Changes to These Terms

We may update these Terms from time to time because of product changes, legal or regulatory changes, security or safety reasons, payment provider changes, OpenAI or ChatGPT platform changes, new features, operational changes, or business changes. When changes are material, we will provide notice where required, such as by updating the effective date, posting in-product notice, or sending account notice.

Your continued use of the Services after updated Terms become effective means you accept the updated Terms. If you do not agree to the updated Terms, you must stop using the Services and cancel any recurring paid features before the next renewal.

30. General Terms

These Terms, together with the Privacy Policy and any feature-specific terms, are the entire agreement between you and Savor Everything for the Services. If any provision is found invalid or unenforceable, the remaining provisions will remain in effect, and the invalid provision will be enforced to the maximum extent permitted by law.

Our failure to enforce a provision is not a waiver of our right to enforce it later. You may not assign these Terms or your account without our consent. We may assign these Terms in connection with a merger, acquisition, financing, reorganization, sale of assets, change of control, or by operation of law.

Headings are for convenience only. The words including and for example mean including without limitation. Sections that by their nature should survive will survive termination, including payment obligations, content licenses, disclaimers, liability limits, indemnities, dispute terms, and record-retention rights.
